ギター弾きの「行政書士開業準備中」

こんばんは、ギター弾きです。
ここ数日、風邪をひいて寝込んでおりましたので、非常に体調が悪いです・・・。
昨日は結構ましだったのですが、そんな風邪もふっとぶような事件がおきましたね。

事件についての個人的な感想はともあれ、公然わいせつに関しては構成要件に合致すると思われ（公然という文言に深夜、誰もいないと思われる公園が該当するかは意見が分かれるかもしれませんが）
問題は公然わいせつ罪という比較的軽微な犯罪に対し、家宅捜索が行なわれた行為が刑事訴訟法上の別件捜索にあたるかです。
判例では裁判官は「被疑事件との関係で、捜索の理由と必要性があるか」を判断しますが、公然わいせつについては、本人が認めているわけですし、家宅捜索をする必要性はありません。（ていうか、それ以前に現行犯ですね）
となれば、この捜索はあくまでも「薬物の疑い」のための捜索となります（尿検査までしたそうですから）
こうなると、上記判例にプラス「差し押さえの理由と必要性」も認められた場合に、はじめて「令状を発布しての強制処分」がなしえるわけですね（強制処分法定主義）
つまり結局、余罪の取調べをすることが合法かという論点に帰着するわけですが
学説では余罪の取調べは許されないという事件単位の法則が主張されていますが、どうも実務上では「法が制限をかけていない」
という判断のもと余罪の取調べはなしえるという判断のようです。
ただ、この場合「同種事犯である」とか「余罪が本罪と密接な関係を持つ」とか「本人が進んで余罪を自白した」という限定的な場面でしか認めるべきでないと考えられるので、今回の家宅捜査に関してはかなり黒にちかいグレーな捜索だったな
と僕は思うのですが・・・

きっと警察側としては「余罪が本罪と密接な関係を持つ」という解釈なんでしょうけれど、これは、どうなんでしょうね・・。

そして、僕達行政書士開業をする者にとっても警察等の「決めつけ」には合わないようにしないと疑われたら恐ろしいと思いました。
