ギター弾きの「行政書士開業準備中」

昨日とりあげたドラマの内容を確認することができました。
昨日の時点では、「どちらかわからない」と書いていましたが、ドラマを見てからの判断としては
100%アウトです！

弁護士会の指摘どおりでした（泣）

ドラマでは相談場面冒頭に「行政書士　金子いずみ　結婚離婚相談所」という看板が映し出されます。
続いて行政書士（と思われる女性）が「一回目の調停は大変良かったです」と依頼者に言っております。

オイオイ！調停って・・・。行政書士が調停に立ち会ったのか！？友人としてですか？（ならば極悪！）

つづいて陳述書作成についてのアドバイスをする。

これについては、確かに陳述書の作成は事実証明の書類として作成代行する行政書士も多いが、今回は調停に入っている訳なので、紛争性ある事件に介入している極めて黒に近いグレーかと・・・

↑しかも、ドラマでは作成代行のための資料等を集めるためのアドバイスではなく、本人に作らせ、かつ有利に調停をすすめるためのアドバイスです（非弁）

もうね、行政書士のイメージが悪くなる一方ですよ、コレ
行政書士は非弁してる奴ばっかりというイメージが大きくなるだけ、カバチもそうかもしれませんが、一般人に宣伝になるどころか、他士業からどんどん睨まれてやりにくくなるだけ・・・

弁護士会ではなく、行政書士会が先にNHKに抗議すればカッコ良かったのに・・・・

ていうか事務所名（？）が、「結婚離婚相談所」って・・・
これは行政書士事務所が離婚協議書作成代行しているどころか
非弁NPOかなんかが、行政書士の肩書き利用している感じですよね・・・（ドラマの人はバッチもつけず、あやしさ満開のセンスない格好です）
実際、そういうとこホームページでめちゃひっかかるとこありますよね（行政書士ですらなかったと記憶してますが）
↑なんか、カウンセラーとか肩書きつけてたかな
独自の認定（スクール？）みたいなんもしてるようでしたが、カウンセラーと銘打ってもやってることが離婚問題相談（法的な）ですから100%非弁やと思いました。（個人的には弁護士会、非弁取締委員会の皆様にはまずこっちをなんとかして欲しいと思います）

行政書士もこういうあやしい団体と同視されないよう、襟を正していかねばなりませんね・・・

行政書士って、「街の法律家」と謳ってていますよね。それって、一般の市民は、些細な揉め事は、行政書士が対応して解決しますよと解釈してしまいます。そもそもテレビや、漫画で行政書士を取り上げる理由ってなんだと思いますか？
弁護士は、報酬が高いし、すぐ裁判にして、勝っても負けても裁判所の判断だからと割り切れるけれど、一般の市民の方、特に経済的、肉体的弱者の方は、弁護士に依頼するお金も、裁判にかかる時間もないわけで、挙句の果てに裁判所の決定だから仕方がないでは、本当に困るわけですよね。自称法律のプロというなら、相談を受けた段階で、回答が出なければおかしいわけですよ。仮にグレーゾーンで訴訟にしても。裁判によって、方向性をきっちり見定めるのが弁護士の専属業務だと思います。先に戻りますが、テレビや、漫画って、その背景には視聴率や、印税やら利益を念頭にしています。そのために面白おかしくしてフィクション化するのは当たり前です。それに異議をとどめるのは、法律のプロという自覚と自信がないように思えます。つまり、行政書士の非弁行為で異議を唱える弁護士は、人間が小さすぎるとしか言いようがありません。われわれ士業は、悩みのを抱えた市民のために、誠心誠意対応し、武士の志と同じように、命をかけるしかないのではないでしょうか。

Koujiさんは、当ブログの他の記事を読んで頂けた上でコメントしてくださったのでしょうか？
基本的に私は、行政書士という制度を一番大切に思っておりますし、同時に最も重視すべきは市民の皆様のお役に立てることと考えております。

それを踏まえた上で、今回の記事のようにグレーゾーンを越えそうな仲間（私は弁護士ではなく、行政書士ですよ、念のため・・）に警鐘を鳴らしております。

紛争性ある事件を法規定上扱えない士業者が、それを知らない市民の方の依頼を受けて、行動すること、その結果、弁護士法違反等で報道されたり、逮捕されると、もっと不利益をこうむるのは依頼した一般市民の方です。
違法性ある状態で遂行した法律行為は当然、取消えるべき行為と認識され、結果的に依頼者には時間とお金が失われ、マスコミや警察・検察等に事情聴取されるというわずらわしさまでつきまといます。

これは最初に依頼を受けた士業者がそれぞれの職域を厳密に意識し、それを守らない場合におきる悲劇です。

弁護士も、人によっては市民の目線にたてない方がいるのは百も承知ですし、そういう方からの相談を受けることもよくあります。

ですが、すくなくとも私がご紹介する弁護士さんや司法書士さんは、自分勝手に裁判をしたり、むやみに高い報酬を取る人はいません。
正直、泣く泣く無報酬で依頼者を助けられた司法書士さんや、弁護士さんもいます。
残念ながら行政書士は無報酬であっても、このような紛争性ある案件を継続的に扱うことはできません（たまたま、一度や二度、発展したものを無報酬にした人等はいるでしょうが・・・）

また、同じ意味で
私個人としては視聴率や、印税やら利益を念頭にして、面白おかしく誤った情報を届ける番組が好きではありません。これこそ、Koujiさんが一部の弁護士等に抱かれる気持ちを同様のものがあります。

利益のためなら、何をしてもいい。
という考えが好ましくないことに法律家もマスコミも、ネットもありませんよね・・・。
