ギター弾きの「行政書士開業準備中」

前回の記事に他士業は行政書士の業務について理解していないようなことを書きましたが
そもそも行政書士（行政書士予備軍）ですら、行政書士の業務について非常に曖昧な理解をしていると感じます。

そもそもはじめに行政書士法をとことん勉強すべきだと思うのですが、たいていがいきなり民法だとか会社法だとかの勉強や実務の勉強のみにまい進するのではないでしょうか・・・

ずいぶん以前のことになりますが、僕が受験生日記をブログでつけていた頃、試験勉強をしていることがきっかけで仕事をしている先から法的な仕事に携わらせてもらえるようになった旨書いていたのですが、これを見た同じ受験生だか現役行政書士から「行政書士登録もしてないのに、そんなことしたら行政書士法違反だ！」みたいな書き込みがありました。
当時、忙しく更新もまったくしていなくなっていた時期なのでスルーしていたのですが、続けて「雇用関係にあればできる」だとか「できない」だとか書き合いがなされました。

正直、これはいただけません。
その方たちは行政書士の「独占業務」と「非独占業務」の区別ができてなかったわけですね。
僕が書いていた仕事はそもそも「非独占業務」でした。
はっきり言ってしまえば、誰でもできる業務。具体的には社内のホームページ作成に付随して肖像権を侵害しないための措置や著作権を侵害しないための措置。
他の従業員が違法コピー等したり、個人情報を流出しないための対策などは専門家でなくてもできるわけです（非行はおろか非弁ですらありません）。
だいたい、自分達は「非弁、非弁」と非弁の取締りに批判的な意見を主張するわりに、いざ非行政書士が（自分らの解釈で）非行していると思えば警告するとは（しかも、それを業として行なっているのかの事実確認すらせず）非常に情けない行為です。（それがしかも他士業ではなく、将来的に仲間になろうという行政書士受験生のイチブログに対して）

多くの行政書士のページやブログを見ても、配慮に欠けるものが多いです。
（非弁、非司法書士、非社労士の誤解をまねく記述が非常に多い）
行政書士で紛争性さえなければ、なんでもできるとでも言いたそうなページがゴマンとあります。

スキーを習いにいけばまず転び方を学ぶ、柔道を習えばまず、受身の仕方を学ぶ。
行政書士を開業しようとするなら、まず行政書士法を学び違法行為をしない。
これが絶対条件だと思います。
そもそも試験科目から行政書士法をなくしたのは疑問でなりません。
受身を学ぶという意味では刑事訴訟法の捜査の分野くらいは試験科目に必要でしょう（これは告訴関係の実務にも生かせますし）
本当なら基礎法学では刑法を中心とした法解釈を出題すべきで、ADRだとか国会だとか憲法改正などを題材にしたクイズみたいな問題を出すべきではないと思います。

と、まー今回はかなり批判的な記事になりましたが、行政書士法のグレーさについては追々書いてみようと思います。
