ギター弾きの「行政書士開業準備中」

こんにちは、ギター弾きです。
登録が済んで2ヶ月。はじめは情報が入ってくるから
ということで登録したつもりが、できるとなれば業務もしたくなるもので、いろいろ宣伝して
結果的に結構たくさんの相談を受けております。

相談途中、進行中、業務完了も含めて
受けた依頼はバラエティー富んでいて、行政書士の業務範囲の広さを思い知っております。

今回は僕がこの2ヶ月で受けた業務のいくつかをご紹介。

①誓約書の作成
登録が済んで一番初めに受けた相談がバイク屋さんの売買契約に関するものでした。
遠隔での販売で「相手方の雰囲気から後々トラブりそう・・・。」という相談を受けたので、契約書内に必要な事項の追加することを提案しましたが、契約はいつも定型のものを使用しており、すでに交付済みとの事。
やむをえないので、こちらで別に誓約書を作成し、これを相手方に送り一筆もらうように助言しました。
これは、すぐに完了させましたが、その後のトラブルは発生せず、無事に終わりました。
行政書士向けの予防法務的業務だったので、やりがいを感じれた業務です。

②会社設立の相談
これは、よくある行政書士の業務ですね。2件受けました。
そのうちの1件は、ツレからのもので、相談に乗っているうちに会社化するのを延長することに(汗）
もう一つは年商１０００万を越えた事業をやっている方で、そろそろ会社化すればどうか、といった提案をしました。
会社化にあたって必要な事項なども助言しました。本格的に決定するのは来年になりそうですが、その時までに設立業務を完璧に自習しておかなくてはなりません。

③事業開始に関しての相談
これは、前々からおこなっていた業務の延長です（行政書士関係なく）。
飲食店関係が2件あって、こちらは行政書士になったからこその業務でしたね。
しかし、もともと経営に関するマーケティングなんかは業種問わず相談にのっていました。
また、業務として追加で公的融資申込書作成に付随して、依頼者と開業についてのビジョンを突き詰める相談ものってみました（従来から相談にのっていた人に提案）。
これについては、相手方が現在、物件を探している最中なので、現在も継続中の案件です。
是非、依頼者希望額を借りれるようにしたいですね。

④離婚に関する相談
離婚協議書の作成を前提に数件の相談に乗りました。
例えば、そのうちの一件は離婚原因としては充分ともいえるものがいくつかあったのですが、一方当事者が独断で相談しているようだったので、「まずは、相手方に離婚の意思があるか確認」してもらうことと、相手の同意がないようだと当事務所ではなく、知り合いの弁護士さんを紹介することで、今回は止めました。
正直、離婚関係は相談の時点でかなり難しい問題が多いと思いました（行政書士業務範囲では難しい）。
ちなみに離婚に関する相談は結構受けますよ。現在のところで6件かな。
実際に手続きまで行きそうなのがその中の3分の1になりそうかな・・
結構、微妙なゾーンの仕事が多いので、弁護士さんへの紹介になってしまったり、ご自身で調停をするように進めることが多いですね。

⑤肖像権侵害の相談
有名モデル事務所の某モデルさんの写真がネット上で不正利用されていることについて相談を受けました。
当初は使用の指止請求を内容証明で送ることを考えていましたが、損害賠償請求等を含め、事件性を帯びてきそうな気配が出てきたので、弁護士へ引き継ぐことになりました。

⑥相続に関する相談
これも3件のってます。
先日受けたものでは、当初はすでに相続が発生しているものと思いましたが、複雑な所有権関係を踏まえた上での、子供達への平等な相続を事前に考えておきたいというものでした。
事情を聞くと、確かに複雑な状況だったのですが、一般的な民法の知識だけで解決可能だったためその場で解決策を提案。
その旨を踏まえて遺言書の作成をすることになりました。
公正証書での作成をするので、はじめて公正証書役場へ出向くことになりそうです。
相続手続きに関しては証拠書類の収集を手伝ったり、関係図を作ったりしてます。
1、2ヶ月以内に協議書の作成も経験することになるでしょう。

⑦著作権侵害に関する相談
僕がIT関係の仕事をしていたからか、ギター弾きだからか、なぜか肖像権とか著作権に関わる相談が多いです。
今回も⑤同様ネット上での著作物不正利用でした。
今回は依頼者自身が意識の高い人だったので、そのまま著作権侵害を理由に使用の差止め請求をする方針が一致し、すぐに管理者側へ請求をして、情報公開と差止め請求を行って、依頼を受けて三日で解決しました。
ネットワークの知識を持っていることで、この手の案件はすぐに解決策を導けることに気付きました。

⑧CD発売に伴う権利関係の相談
前々からアーツマネジメント業務として、相談に乗っていたアーティストがセカンドアルバムを製作、発売するということで
著作権等の調査と、契約・流通・チラシ・ジャケット製作・マーケティングまですべての流れを一括して受注しました。
クリスマス向けのCDだったのですが、今年のクリスマスに間に合わなくなりそうなので、来年に延期。
せっかくなので、前回同様、海外のレーベルからの発売に変更になりそうです。
この手の案件で、知り合いの行政書士さん（同期）も相談を受けていたようで、間接的にその行政書士さんにいくつかアドバイスも行いました。
これまた、音楽業界の知識がないと、かなり辛そうでした。

⑨物件調査
行政書士業務ではないのですが、業務委託を受けている会社があたらしく支店を出すので
入居するための物件調査で法務局に頻繁に出入りし、調査をしました。
この手の業務に規制はないので、企業コンサルをしたい方にはオススメです。
