ギター弾きの「行政書士開業準備中」

こんにちはギター弾きです。

飽和状態…都市部から地方へ　弁護士さん就活激化

行政書士も登録数は4万を超え、今年の試験も制度変更はないようなので、6割得点合格の絶対評価試験で行なえば、特上カバチ！！バブルが手伝い受験者数が10万を超え、そのうち合格者が8%としても8,000人が有資格者、そのうち統計で言われる6割の4,800人が独立開業するかもしれません・・・

さて、司法試験合格者の就職状況は本当に厳しいようです。
僕の知り合いで今年、新司法試験に合格した者がおり、現在司法修習中なのですが、仲間うちの話題はやはり、「就職か独立か」だそうです。
新聞記事の最後にある「ソクドク」という言葉は本当に流行っているようで、僕は「ギター弾きさんは、ソクドクされたんで、すごいです！」と言われました（汗）

すかさず「いや、行政書士は司法修習も就職先もないので、これが普通やで。」と説明しているのですが、いずれにしても、根性は買われています（笑）。

彼の話によれば、最終試験の結果なんて、関係なく司法修習中の成績と出身大学のみで就職は決まるようで、関西では「京大以外はコネがないと就職できないんです・・。」と京大（ロー）出身でない彼は言っておりました（コネはあるそうですが）。

こうなってくると、いよいよ司法書士、社労士、行政書士の職に手を出す弁護士は増加することでしょう。
実際、「各種許認可」と業務内容に書いている弁護士事務所の広告を先日見かけました（涙）。
登記や遺言ならまだしも、これはさすがに驚きました。

個人的には年間60万近くの会費を納めて行政書士業務をするくらいなら、はなから行政書士で良いと思います（ロースクールの学費や司法修習時代の生活費で1,000万円は投資しないといけないですし・・）。
さらに、司法試験に受かるために費やした勉強時間を社会経験や営業の勉強に費やさないと「ソクドク」とやらをしても、廃業しかありえません。

記事では弁護士会がソクドク等の「新人弁護士の支援にも力を入れる」と言っているようですが、そんなことで弁護士が食えるようになるなら、現時点で1割ものベテラン弁護士さんが生活保護を受けている現状は改善されているはずです。

となれば、最終手段としては隣接法律職である社労士や行政書士などを弁護士72条「事件性不要説」により、排除するという手段が考えられますが、おそらく現実的には無理でしょう。
（それどころか、場合によっては弁護士法72条緩和の可能性の方が高いかもしれません。）

ということで、妥協点としては、隣接法律職を「準弁護士」として、弁護士会が取り込む作戦に出るかもしれないですね・・・。
でも正直、これだけは勘弁です。

特に僕は「争いに介入しない行政書士」というブランドで仕事を開拓していますので、「準弁護士」なんて紛らわしい肩書きになったら、仕事が取れなくなります（涙）。

どうせなら、売れっ子弁護士の西田先生がおっしゃるように他士業は提携か、パラリーガルとしてこき使うという方法の方が適切でしょう。

いずれにせよ、行政書士や社労士の寿命は、弁護士大量増加が安定する、あと5～10年なのかもしれないな・・・
などと、たまにネガティブに考える今日この頃であります。
