ギター弾きの「行政書士開業準備中」

こんにちは、ギター弾きです。現在、様々なご依頼を頂いている関係で、こちらの更新がなかなかできませんが、じっくりとお待ち頂けると幸いです。

さて、「行政書士資格の正しい使い方③」では行政書士資格で行える業務の線引きを他士業資格を交えながら書くということで、とりあえず「官公署に関する書類」の作成とその提出代理、相談業務」について書いた訳ですが、今回は特に新規開業者が非常に強い関心を持っていると思われます「権利義務に関する書類の作成代理、相談業務」です。

分析其ノ二、「権利義務に関する書類の作成代理、相談業務」

なぜ、みんなが非常に強い関心を持っているかと言うと、この「権利義務に関する書類」がいわゆる弁護士法違反（非弁行為）と最も密接に関連するからなんですよね。

まずは行政書士会の説明をみておきましょう。

「行政書士は『権利義務に関する書類』についてその作成代理、及び相談を業とする。
『権利義務に関する書類』とは、権利の発生、存続、変更、消滅の効果を生じさせることを目的とする意思表示を内容とする書類をいい、主なものとしては、遺産分割協議書、各種契約書、念書、示談書、協議書、内容証明、告訴状、告発状、嘆願書、請願書、陳情書、上申書、始末書、行政不服申立書等があります。」

この中で前の記事にも取り上げたニュースも含めて問題によく挙がりやすいのが「遺産分割協議書」「契約書」「示談書」「離婚協議書」「行政不服申立書」あとは、たまに「内容証明書」でしょうかね。

書類作成や相談業務についての詳細な解説は後に回すとして、まずは前回の「官公署に関する書類」同様、他士業との関連をみてみます。


・司法書士との関係
往々にしてよく誤解されがちなのですが、司法書士は原則「裁判所・法務局・検察庁に提出する書類の作成」が業務範囲であり、司法書士法３条５項には「前各号の事務について相談に応ずること。」とあることから、行政書士同様「裁判所・法務局・検察庁に提出する書類」に関連する事務についての相談に応じることは可能ですし、140万円未満訴額の簡裁の範囲内であれば、和解・示談というような交渉のアドバイスも行えるかもしれません。
しかし、それに関して司法書士が内容証明、契約書、示談書、協議書の類を作成することは実はできないのではないでしょうか？

この点について遺産分割協議書は法務局管轄の登記に必要な「添付書類」だから付随業務として司法書士に作成できるとか、簡裁を前提とした示談交渉に付随する書類だから和解書・示談書が作成できるとか、そういう解釈をする人がいるようですが、これはちょっと強引な気もします。
これは定款の作成に付随して行政書士が「商業登記できる」と言っているようなものです。告訴状については本ブログで前回の「官公署に関する書類」に含めましたが、行政書士会の説明では権利義務の書類に含まれます。警察、検察への提出先によって行政書士、司法書士いずれが関与するかについては前回の記事を参照ください。


・社会保険労務士との関係
法解釈上では、という意味ですが行政書士が労働者の不利益について労働者自身の意思でなんらかの主張があるならば、その意思表示を内容証明にて「嘱託人の嘱託の趣旨内容を正確に法律的に表現し、法律常識的な知識に基づく整序的な事項に限って」作成の代理をし、発送することができます。
もちろん、労働契約書などを作成することも可能ですが、このような依頼はほぼ皆無です。
※前回触れましたが、就業規則作成については従業員10名未満の従業員の会社の場合であってもできません。

いずれにしても、内容証明作成にはかなり深い労働関係法の知識が必要となりますので、現状の行政書士試験における能力担保ではまったく信頼性がありません。
尚、個人的に僕は社労士、新司法試験における労働法関係はすべて学習して、それでも解決の難しい案件の場合、社会保険労務士のアドバイスを常に受けて業務にあたっております。
もちろん、複雑すぎるとか、業際問題にぶつかる案件は依頼者の同意を得て、社労士と協業します。


・税理士との関係
権利義務に関するもので税理士との関係が問題になるのは行政不服申立書の作成業務ですね。税理士の「無償独占」業務である税務書類の作成には、税務官公署に対する不服申立書が含まれますし、当然これに関する相談なども「有償」「無償」問わず行うことはできません。ですので、行政不服申立書の作成においては税務官公署に対するものは一切関われないと認識し、税理士さんとのネットワークを構築しておきましょう。

・弁理士との関係
弁理士との関係で問題になるのはライセンス契約です。弁理士法の規定が「契約の締結の代理若しくは媒介を行い」と規定されていたり、「著作物の」と明確に規定されているものに対し、行政書士法ではあくまで「権利義務に関する書類」という規定と「行政書士が作成することができる契約その他に関する書類を代理人として作成すること」という規定を根拠に著作物に関する契約書を代理人として作成ができると解釈される。
詳細は後日書きますが、とりあえずはライセンス契約などは弁理士との共管業務と認識しておいてください。


以上、主な他士業との関連を見てきました。
肝心な弁護士との関係をまだ書いておりませんが、権利義務に関する書類についての弁護士業務との線引きは非常に大変です。
何故なら「権利義務に関する書類」は、弁護士法72条にある「法律事務」の解釈に類似しているからです。
また「司法書士、行政書士については、官公署に提出する文書の作成を通じて、法律事件に関する法律事務に関与する程度は大幅なものがあり 」、非弁行為の取締り対象として問題となるケースもほぼ「権利義務に関する書類」に関するものに集中していると言われています。

本ブログで多く取り上げているテーマが弁護士法との業際問題となっておりますので、弁護士との関係については追々じっくり検討していくことにします。

司法書士の部分が特に。
かなり強引な立場で付随業務として内容証明を書くことが認められたとしても、訴え提起などが前提にないと厳しそうですね。
ネット上の敷金返還の司法書士業務って微妙になりません？（訴え提起はしないのが前提みたいですし）
逆に行政書士が敷金返還の内容証明を書いて、相手方から電話を受けて、「あのー本人がこう言ってますけど払ってもらえませんか」などと話すとこれは弁護士業務との業際問題ですかね。

内容証明を通常業務として掲げている司法書士さんは意外と多いですね(^^;)
「ネット上の敷金返還の司法書士業務」は確かに微妙です。同じように司法書士さんがよく「離婚相談」を掲げていますが、離婚協議書作成の相談にのれない以上、いきなり調停を勧めるのかな？（と驚きます）
依頼者の利益を考えれば、全体の10パーセントにも満たない調停や審判を前提にして、離婚相談を掲げるのも微妙だと思います。

ちなみに、内容証明を書いた場合に相手方から電話を受けた場合は「依頼者の主張は書面に書いており、当方は内容についてお話することはできません」と言わなければ、かなり危険ですね。
前に書いたように「書面の内容を説明することは行政書士業務にあたる」という判例もありますが、地裁判決ですし、あくまで一例に止まります。

弁護士法72条との関係はかなりの量になりますので、すこしづづ連載していく予定です。

確かに弁護士だろうがなんだろうが、従わない奴は従わないのだから、そういうやつは裁判所の裁きをうけさせりゃいい。そういうやつに関わるのは弁護士だけ。それ以外の仕事の方が多いんだから、そっちを行政書士は頑張って、必要とする奴らのためになろうぜべいべー。

ってことですよね。（曲解でしたらすいません。）

まあ弁護士法との関連はすごそうですし、気長に待ちます。

あと、告訴関連の記事もリクエストしときます。（普通に考えて需要はあると思うんですけど掘り起こしにくいと思うんです。まあ企業秘密？の部分もあるのでしょうけど、ばれない程度でよろしくお願いします。）

まー、僕が言いたいのもこの「代書屋」と関係してますね。

紛争解決業務をやろうとするとどうしても、依頼者のズレた考えに巻き込まれ、心労が耐えません・・。

枝雀の「代書屋」ではそれを面白おかしく表現していますが、経営的な観点から見れば、厳しいものがあります。

ちまたによくある行政書士のブログとは毛色が違うので興味を持たせていただきました。

昨日は酔っていたのですいません。

いつでもいいのですが、少し疑問に思うところがありまして。

解説書を読んだわけではないのですが、司法書士の条文は読みました。（今さらですが）

それによると３条１項７号で認定司法書士に「裁判外の和解について代理すること」ができるとありますが、これは何が出来ると考えればいいのでしょうか。

普通に考えれば、和解するために交渉はもちろんのことを、和解契約を結び、それについての書面の作成もできると考えられそうなのですが・・・。

和解の代理と和解の書面とは異なると考えるのが妥当なのでしょうか。

個人的な意見でいいのですが、どう思われます？

３条１項７号、これは結構いろいろと意見があるようです。
さとさんのおっしゃられるように「和解契約を結び、それについての書面の作成もできる」という考えが司法書士さんの中では一般的のようです。
これについてはデリケートな問題なのであまり僕が解釈を言うことはできませんが、「登記に付随して遺産分割協議書を作成できる」という立場が認められるならば、「和解に付随して内容証明作成や和解書示談書の作成も認められる」かと思います。
ただ、後者について催告という意味でなら、いずれにしても内容証明の利用は認めるべきだと思いますが、行政書士が行なうような権利義務の主張として行なうのはいかがでしょうか？
これは「和解」を前提としないものになってきますので・・・・。
和解書や示談書に関してはカバチのような行政書士とは逆に、示談交渉（有料）→示談書作成（無料）
で行なうのが条文の忠実な解釈かと思います。

まーいずれにしても、プチ弁護士として業務をするならば遺産分割にせよ、示談交渉にせよ
司法書士と行政書士を両方持っていれば、どちらも有料で行なえると思うので(140万円以下限定）、それが一番無難かと思います。
ですから、行政書士資格のみの場合は「カバチたれません」で行くことをオススメしている次第です(^^)

ちなみに司法書士に裁判外の和解を認めた立法をした経緯には当時多くの被害者が出ていた「クレサラ問題」に関しての債務整理を踏まえていたというものがあり、実際多くの司法書士がこれに取り組んでいます。
ですが、これがかなりグレーで債務者が司法書士は140万円以下限定と知るはずもなく、司法書士の広告を見て相談に行き、140万円以上返還可能な場合も多いわけです。
するとこれを司法書士さんが行なえば弁護士法違反となる危険な業務でもあります。
ここで、弁護士に振る人と、訴額を無理矢理140万円以下にしちゃう人がいるわけですが、とある都道府県では後者があまりに多かったらしく、現在弁護士会が司法書士会を訴えています。（債権額説VS受益説）

このようなことからみても、裁判外の示談交渉、あまり良い業務のようには思えません。
