「士業」の境界めぐり応酬　行政書士会と弁護士会

さて、皆さんはこの件についてどう思われるでしょうか？

先日、このブログでも取り上げた弁護士会の告発に対して鳥取県行政書士会が「いわれなき業務妨害には会として対応する」と全会員に通知していたというのですから、鳥取県行政書士会の立場としては、当然離婚手続きの相談に応じることや、それに関して内容証明などを送ることは行政書士の業務にあたるという見解になりますね。

前回のブログでも書きましたように、僕も「紛争性を帯びていない限り」は行政書士の業務範囲内であると考えてます。

問題は記事の後半、大阪弁護士会の小寺史郎副会長が「行政書士事務所を名乗って返事を要求した点で対面上の交渉と何ら変わらず、明らかな非弁活動」とコメントしている箇所かなと思います。

かつて弁護士会は「事件性不要説」を唱え、事件性があろうが、なかろうが行政書士が法的な書類作成を行なうことは非弁にあたると主張してきました。

しかし、数年前の規制改革委員会の認識は事件性必要説であることがはっきりしましたし、検察実務においても事件性必要性説を採用していると考えられるわけです。

そこで、今回の大阪弁護士会の告発が事件性必要説に立った場合であると仮定して検討しましょう（ただし、以前大阪弁護士会の関係者に聞いたところ、まだ事件性不要説を支持しておられる可能性を管理者は確認しました）。

「行政書士事務所を名乗って返事を要求した点」
ポイント②
「ポイント①をすれば対面上の交渉と何ら変わらない」

要件事実的な考え方をすれば、「行政書士事務所を名乗って返事を要求」しただけで要件に合致するという考えかたは難しいのではないでしょうか？
問題は「行政書士事務所を名乗って」いったい何を要求したのか？　ですよね。

前回のご本人の主張が嘘でないと考えた場合、「行政書士事務所を名乗って要求」したのは「公正証書作成手続きを進めるか？進めないか？」という質問の回答です。
裏返せば、行政書士がとある人間に対し「私を行政手続の代理人にしますか？　委任状はくれますか？」という確認です。

これは行政書士として仕事をしているとしょっちゅう行ないます。
例えば、遺産分割協議書の作成依頼を受けて、書類を作成している中で、突然依頼者からの連絡がなくなります。

そこで「協議書の作成に必要な書類の残りを送ってください。それとも、今回の依頼はキャンセルになりますか？」と二度ほど確認したことがあります。
結果的にどちらもお仕事で忙しくて、連絡が途切れていただけなのですが、場合によっては当初円満だった協議が途中でこじれて、依頼人が弁護士に変更しようか悩んでいるかもしれないのです（当事務所ではこじれた場合、即座に依頼をキャンセルし、弁護士に引き継ぐという説明をはじめにしているため）。

ですから、行政書士として確認するのは問題ないのです。
ここで問題となるのは、これを依頼人以外の関係者に行ないうるのか？ということですよね。
「ポイント①をすれば対面上の交渉と何ら変わらない」

さて、どうでしょうか？
先に述べたように、話がこじれていたら、預かっている権利証やらをすぐに返さないといけないし、こじれていないのだったら、早く書類作成や手続きを進めないといけないし、「う～ん、どっちなんだ！？」と（例えば遺産分割協議の場合でも）「依頼人より、分割協議書作成を委任されておりますが、私が作成を進めても問題ありませんか？」と確認することは「対面上の交渉と何ら変わらない」のでしょうか？

僕はそうは思えません。僕自身はこのようなケースにぶつかったことがないので、他の関係者に連絡をとったことがないのですが、弁護士法違反をしないように法令遵守しようと思えば、むしろ、これを行なわないことには行政書士業務として行なえるのか、行なえないのか判断ができない気がします。

依頼人だけの言い分を100%信じて依頼遂行していたら、実は大揉めの協議だった（遺産分割にしろ、離婚にしろ）。ではあまりにマヌケすぎやしませんか？
これは、入管業務の外国人に対してもそうです。ある程度、関係者からの事情聴取くらいしておかなければ、違法入国の片棒を知らぬ間に担がされているかもしれないのです。

その点で、今回の弁護士会の意見は、ちょっと違うような気がするのです。

ただ、管理人の見解としては

ここで、弁護士が警告を出してきた時点で、通常の行政書士なら「揉めだしたな！」ということは解かるはずですので、ここで業務の継続はできなくなり、知り合いの弁護士を紹介するなり、相手方弁護士に何らかの提案をしておくべきでした（直接依頼人に話すように言うか、知り合いの弁護士を紹介するまで待って欲しいと伝えるかなど・・）。

ですから、管理人の考えとしては、やっぱり相手方弁護士を業務妨害だの、名誉毀損だので告訴することは間違いであり、弁護士会が今回の件を弁護士法違反で告発することも、おかしいと考えております。しいていえば、虚偽告訴として告発という可能性がありますが、本件では行政書士が、違法と信じているのであり、虚偽告訴としても起訴はされなかったでしょうけど・・・。

まとめると、今回の記事『「士業」の境界めぐり応酬　行政書士会と弁護士会』
については弁護士会の事実誤認。行政書士会の解釈違いではないのでしょうかねえ。

業際問題について、ぼくは行政書士でもないので深く考えたことがなくて、かといって、将来的には交通事故関連の仕事をしたいと思っているので、いずれ避けて通れない問題です。交通事故関連だとこの業際問題がとりわけ先鋭化しそうな気もします。今西錦司じゃありませんが、このあたりのうまい棲み分けって可能なのかなあとちょっと途方にくれたしだいです。

この問題以外にもためになりそうな記事がいっぱいあるように思いましたのでまた訪問したいと思います。

法律問題も公益性の問題もだれかが取り上げないとそもそも問題にならないし、それがかつてのような個々の問題というよりも、団体全体の問題にまでなっているというのが現在の特徴だという理解でよろしいのでしょうか。ぼくはそのように理解しました。
