ギター弾きの「行政書士開業準備中」

ご無沙汰してますギター弾きです。

行政書士の資格がないのに業務で家系図を作成したとして、行政書士法違反に問われた北海道の花香さんが最高裁で逆転無罪になったようですね・・・。

今回はこの件について、書いてみます。
僕は、この件に関して「まー、たしかに無罪でしょうよ・・・」と思う反面、最高裁が判決を下したというイメージから相当の問題も生じると思っております。

まず、最高裁第１小法廷の言う「問題となった家系図は、個人の鑑賞や記念のために作成されたもので、対外的に意味のある証明文書としての利用は予定されていなかった」というのはまさにその通りです。

そしてこれらを作成することを業として行政書士以外のもののが100万だろうが1,000万だろうが報酬を得ることに関しても、まー好きにすればよいと思います。

問題は

家系図の作成自体＝誰でもできる

ということと

戸籍収集＝誰でもできる

ではないということです。

平成15年の個人情報保護法施行以来、それぞれの役所において戸籍等の請求に対する応対は厳格になっております。
我々、行政書士でさえ、会の指導で家系図の作成を目的に職務として戸籍の請求をすることは禁止されています。

相続などは仕方ないとして、家系図作成という、ただ一人の利益のために関係ない親族等の個人情報が収集されることは、近時においては許されないからです。

それなのに、行政書士資格を持たない者がこれらの戸籍を収集できるということはあり得ません。
考えられるとすれば、一族すべてから委任状を得て、ぞれの個人で可能な範囲のみの血縁関係を家系図にするものですが、それでは家系図というにはお粗末な範囲のものしか出来ません。

では、行政書士資格を持たない花香さんはどうやって家系図を作成していたのでしょうか？

記事では「花香被告は06～07年、２人の行政書士（廃業）から買い取った行政書士用の専用書類を使って自治体から不正に戸籍謄本を取り寄せ、依頼者６人の家系図を作成」とあります。

これは我々の用いる「職務請求書」を指します。まず、これを行政書士以外に売買した会員自体に問題がありますが、ここでは深入りせずに続けますと、2007年に戸籍法が改正し、不正に戸籍謄本の交付を受ければ三十万円以下の罰金。虚偽の届出の場合でしたら一年以下の懲役もあるわけです。

つまり花香さんがこの業を行っていた当時と現在では、まったく事情が違うわけで、この最高裁の判決を盾にして多くの無資格者が家系図作成を業務としようとしてしまうと、別の問題が生じるというわけです。

しかし、このような判決が広くマスコミで報道されてしまったことで、少なからず「報酬100万！？　俺もやろう」と思うものは出てくるのではないでしょうか？

花香さんも「家系図販売業を再開したい」と言ってますし・・・

なお、僕は家系図作成はもともと行政書士資格の予定する業務であるとは思っていませんし、以後も家系図作成を業務としてするつもりもまったくないので、今回の報道によって何のデメリットもないのですが、これを真に受けた行政書士以外の者が、あちこちで家系図作成業をはじめたら、(一般の方で)不利益をこうむる人が続出するだろうな～と危惧しております。

逆にこういう者（不正請求者）に対する告訴業務をメイン業務にされると、家系図特需として需要があるかもしれません。興味ある方は取り組んでください（笑）

余談ですが、法務局側から平成9年付で「行政書士による除籍謄本の交付請求について」という題目のもと「行政書士が「家系図作成」を目的として傍系家族の除籍謄本を請求することは、職務上の請求に該当しないというべきであり、本件請求には応じるべきではない」と回答があったこともありますので、2007年の時点で花香さんが行政書士の職務請求書を利用して家系図作成をできたことは、行政側のミスでもある気がします。

いずれにしても、行政書士のみなさんは家系図作成などという参入障壁の低い微妙な業務に励まれず、自身の専門的な業務を見出していただき、頑張っていただきたいですし、行政書士でない方が家系図に取り組まれる場合は、依頼者の有する記録や記憶のみを頼りに取り組んで頂くか、あ
るいは関係者すべてからの委任状をもとに可能な範囲のみの家系図作成のみに取り組んで頂きたく思います。
