ギター弾きの「行政書士開業準備中」

こんにちは、ギター弾きです。
結構、間が空いてますが記事をズレて書いてます。今回は7月上旬に登録申請した後、わずか数日で支部長さんが事務所訪問に来られた時の事を書きます。

ちょっと驚いたのが、「２、３週間したら事務所訪問します」と言われていたのに、数日後に来られた事と登録完了が2ヶ月以上かかると聞いていたのに、支部長から「1ヶ月後には完了する」と教えてもらったことです。これで、いい意味でも、悪い意味でも予定が変わってしまいました。

さて、それはさておき事務所訪問の際の様子を記します。

僕は独立事務所だったので、約束の時間のちょっと前に事務所に向かったのですが、なんと先に支部長さんを待たしてしまっていました（汗）
冷静に考えたら相手は場所わからないわけで、かなり早めに出られている可能性は高かったのに、それを読めていなかった（反省）。

以後の教訓にしようと思います。

さっそくソファーに座って頂き「何か飲み物出しますね」と言ったのですが「すぐに終わりますので、結構ですよ」とのこと
あまりしつこく勧めてもアレなので、言われたとおりにしたのですが、こういう場合はそれでも出すべきなんですかね～。

間髪を入れず「独立事務所ですね～。これは本気だな～。」と笑って言われておりました。
「すぐに専業する訳ではないのですが、やっぱり形だけは作っておこうと・・」と答えた僕に
「たいていは初め自宅開業なので、すごいですよ。立地もいいですし・・・」とお褒めの（？）言葉。

そういいながら、申請時に提出した写真の設備と実際の位置などをチェックして頂き、家具がオシャレだとか、金庫も準備している人は珍しいとか、いろいろコメントをもらいました。
「金庫って要件にありませんでしたっけ？」と聞いたら「あれは参考ですよ。それよりも書庫がないのがマズいかな。やっぱりお客さんの個人情報・・・・・・。」とセキュリティの必要性をしばらく解説いただきました。
みなさん、登録時には金庫より、書庫ですよ（笑）！

それと電話があるけど、FAX付でない事をツッコまれました！
「電話と共用にするか、FAX別にするか迷っていて、今に至ります・・・」と正直に言うと
「書士会からは結構、FAX連絡が多いので登録完了までに用意しといてくださいね」と釘をさされました。
ここまでで感じたのは「この支部の支部長はめちゃくちゃ人が良さそうだ！」ということです。
まー他の支部を見たわけではないのですが、一番栄えている地域の支部だったのでイケイケの支部長だったら怖いな～。と平和ボケの僕は思っていたのですね。

そして、しばらくは「どんな業務をやっていきたいの？」という感じで仕事の話。
とりあえずギター弾きであることと、それを生かした業務を将来に見据えていること。
当面はいろんな業務を手広く試してみて、企業・IT法務と相続・後見あたりを中心にしたい事を告げると
「得意分野があるんだったら、是非そちらをやってください」と意外にもギター弾き兼行政書士を認めてくれる反応と、さらに「うちの地域は成年後見に力を入れているので、是非活動に入会してください」というお誘い（もちろん登録完了したらですよ）。
実は、その支部長さん司法書士さんでもあったので、「成年後見は行政書士より、司法書士の分野というイメージが強いので・・・」と任意後見のみ考えている旨、伝えたのですが
「いえいえ、うちで活動している法人は裁判所からも認められているので、行政書士資格でも入会してもらえば、成年後見も扱えますよ」との事。これまたびっくりな話でした。

確かに後見人に選任されるのは名簿に載っている中からで資格要件はなかったと勉強した記憶はありましたが、実績として行政書士が選任されているとは・・・（うちの地域で）

それと、司法書士の資格を持っておられるので（無意識に）行政書士業務の範囲を遠慮気味に言っていたのですが、「むしろ、行政書士の方が枠にとらわれない業務が扱えるので可能性が広がりますよ、遠慮せずにどんどん（逸脱しない範囲で）業務に手を出してください！相続・遺言はやっぱり（司法書士ではなく）行政書士の業務なんです！」と言い切ってくださりました。

実は僕の思っていた先輩（年輩）行政書士さんのイメージは「許認可メイン。弁護士法無視（あるいは理解不足）。新人に厳しい」だったのですが、実際はまったく違いました。
支部にもよるのかもしれませんが、かなり弁護士法との業際を勉強されているようで必須研修がなんと！「弁護士法違反にならないための業際、二日日間缶詰研修」らしいです。（正式名称じゃないのでご注意を）
そしてやっぱり（特に）新人には権利義務の分野をどんどん開拓してもらいたい！と思っておられるようで、許認可は絶対条件であるものの、積極的には権利義務をやりましょう。という主旨のアドバイスをもらいました（本当イメージと全然違いました）。

さて、行政書士試験勉強を頑張っておられる方や、登録しようか迷っておられる方。
これを励みにどんどん登録しましょう。
やっぱ内部事情は入ってみないと全然わからないようです・・・。

PS.支部長さんが帰りがけに（古畑任三郎のように）「あ、ちなみにこの事務所、家賃めちゃくちゃ高くないですか？」と心配そうに聞かれたので「こんな景気ですから、めちゃくちゃ値下げ交渉して月●●円です」と答えると「ええ！それはめちゃくちゃ安い！それだと独立でもやっていけそうですね」と言っておられました。
数年以内にこの建物、行政書士だらけになったらどうしようかな～なんて一瞬思いましたよ。
