ギター弾きの「行政書士開業準備中」

こんにちは、ギター弾きです。

僕は受験生の頃からよく、行政書士試験についてブーたれておりました。
言い換えれば行政書士会にブーたれていたわけです。

で、こういう試験に対する愚痴なんてのは、受験生が書くと「単に試験に落ちた奴の負け惜しみ」に見えちゃうようなんですけど、僕はそんなつもりはまったくなく
将来自分が大切に職業としてやっていきたい行政書士という制度に対しての「真摯な不安の表れ」だったのです。

僕は受験を決意した時から、試験勉強ではなく「行政書士て何ができて、何ができないの？」ということを徹底的に調べました。
近所の行政書士さんに話も聞きにいきました。
あらゆる事務所のページも調べましたし、他士業との業際問題も研究しました。

その後で、試験の勉強をはじめたのです。

資格試験受験生はとかく、こういう当たり前なことをすっ飛ばしがちなんですけど、これは当然のことではないでしょうか？

自分がこれから長くにわたってお世話になる事に対して、何の知識もなくなんとなくゲットして、なんとなく利用する。
僕はこれは「お金と時間」があまりにももったいないのでできません。

買おうと思った車をきちんと調べもせずに、お金を出して、しかも手に入れてから考えればいい・・
なんて変じゃないですか？

手に入れる前にこそ、吟味すべきことです。
だから僕は受験を決意し、教材などにお金をかけるまえに「本当に自分に必要か、どのように利用できるのか」考えたわけです。

すると、試験勉強していく中で
「こんなん行政書士に関係ないやん！」「なんでこんなん問題にして、あれは問題にしないの？」
なんて、ずっと疑問が出てくるんです。
やがて、行政書士試験センター（行政書士会）は一体どこに行こうとしてるんだ？
と疑問を持ち始めるわけです。

前にブログでこのような愚痴に対し「行政書士試験は法的思考の基礎の基礎をチェックする試験なんだから、仕方ない。それが得点できないからって愚痴るな」
みたいな書き込みをしてもらったことがあるんですが
僕は別に基礎法学や基礎問題を落としたから書いているわけではなく（得点してましたし）
明らかにその基礎の視点がズレている・・・（実務と）
と指摘していたのです。

その点、開業後に行政書士会と触れるようになって気付いたのですが、同様の問題意識をされている行政書士さんが段々と増えてきつつあるようで少しづつ改善されております。

原因は法学部出身の新規登録行政書士が増えたことや、ロースクールにいったものの
司法試験を目指さず（あるいは受からなかったため？）行政書士になられた方が増えたからのようです。

おかげで、すこしづづ行政書士会がいい方向に向かっているような気がします。

先日、違う用で行政書士会と話していた時にたまたま聞いた情報なのですが
行政書士会が全国的なとある組織を立ち上げるようです。
何かはまだ、言えないのですが僕から見て「絶対、行政書士として、また今後の社会状況からして妥当な内容」の組織団体となるものでした。

行政書士会、グッジョブ！！

また、全国必須の研修なども始まっていますが、日弁連を講師に迎え
きちっとした法的知識（試験でこういうのを出すべき）を研修されてます。

これは、試験に反映したいけど、いろんな事情で難しいから、せめて研修でやっちゃえ！
という一部の関係者の唯一の措置なのかな？と思います。

しかし、近い将来試験制度は再び変わるかもしれません・・・
さもないと、本当に行政書士制度存続に関わりますから・・・・

なんか、受験生に対しては不安に陥れる記事ですけど
例えば僕が利用した「行政書士試験　突破塾」とか
他にも伊藤塾なんかのような法的思考の重要性を考慮した教材を利用すれば、恐れることはないと思います。

行政書士の資質向上が達成されることを祈ります。
