ギター弾きの「行政書士開業準備中」

こんにちは、ギター弾きです。
お気づきの方もおられるかと思いますが、僕自身の個人的なブログは別で運営しておりますので
本ブログは徐々に同業者、行政書士試験受験生向きのマニアックな内容になりつつあります。

今回は他士業を含めた行政書士資格の行く末です。（近い将来）

12月4日付の規制改革会議によれば
①行政書士への不服申立代理権付与は相当濃厚なものとなりそうです。
同時に②社会保険労務士には簡易裁判代理権、③税理士の公認会計士化が挙げられております。

ここからは個人的な意見となります

②については労働問題に限定したものとなることは想像に難くないでしょう。
しかし逆に言えば、労働法関係は行政書士や司法書士の参入すべき分野ではなくなるかもしれません。
ただ、簡易裁判という形では司法書士が、内容証明による請求という形では行政書士が法解釈上では行えるので、依然業際問題は残ることでしょう。（僕も先日、とある企業から解雇予告手当の支払いについての内容証明代書依頼を受けました）

③について、これは新会社法には会計参与が税理士に認められてますので、監査の部分を税理士に開放するのかもしれません。

①については、行政書士会の長年の夢でありますが、規制改革会議にあがっていることから、かなり可能性が高まってきましたね。これは例えば現在の警察機関への告訴状を代理人として作成、提出できるのと同様で弁護士との共管業務となるのでしょう。
気になるには他に司法書士の名が挙がっていることです。弁護士は当然ですが、司法書士に行政法の素地がまったくないのですから、こちらは疑問が残りますね。いつぞやの行政書士の商業登記が否定されたのと同じ理屈にならないとおかしいと思うのですが・・・

いずれにせよ、規制改革会議の趣旨としては「競争を通じて本来国民が享受できる良質で多様なサービスの供給」の実現のための「資格者間の垣根を低くすることにより各種業務分野における競争の活性化」であることから、司法書士、社会保険労務士、行政書士あたりは少しづつ融合していくのかもしれません。（余談ですが、同時に新司法試験の受験資格や制度自体の見直しが検討されます ^ ^）

この規制改革会議、特に法務・資格制度の専門委員がなんと、阿部泰隆教授（中央大学総合政策学部教授・弁護士）です。
行政書士に興味のある方なら、ご存知の方も多いですが、著書「行政書士の未来像」で弁護士でありながら、行政書士の権限拡大などに言及されている数少ない先生です。

僕も、中大の卒論（行政書士を中心とした業際問題をテーマにしました）において阿部泰隆教授の説は多く引用しましたが、かなり昔から、未来の行政書士像（まんまですが・・）を的確に表現されてました。
ただ、僕は一応法学の卒論という観点から、阿部泰隆教授の立場を批判的に取り上げたりもしましたが、行政書士的には大賛成です。

さて、行政書士の今後はどうなっていくのでしょうか・・・・
